Placing Orders

Orders can be placed on this site or via email. At Choccotastic Ltd we are dedicated to total satisfaction, but, as all products are handmade there may be slight variations on design or colours to those shown on the web site. Products are subject to availability and we reserve the right to withdraw items due to unforeseen circumstances.

Our right to refuse your order

We reserve the right to refuse to accept your order for any reason including, without limitation and whether or not payment has been received by us, if: We have insufficient stock to deliver the goods you have ordered; We do not deliver to your area; or One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do refuse your order we will notify you by e-mail, and, will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered. 

Confirmation of Received Orders

When you have placed an order a confirmation will be emailed to you. We ask you to check this carefully and if any changes are required please let us know immediately.

International Customers

We do not currently ship any goods outside the UK

Payment Online

We will debit the whole price of the goods from your preferred payment card at the time of the order. We have the right to terminate our agreement with you if you refused payment. In order for the payment process to run smoothly, the address details are required of the credit/debit card holder. This will then be used to validate the order. Incorrect details given will result in delaying the process of your order.

Credit Card Security

All credit/debit card numbers are encrypted when the order is placed using 128 bit encryption. Numbers are not held on any computer.

Prices

We try to ensure our prices on the website are correct at all times. However, our products are subject to market forces and we reserve the right to change the prices at any time and without prior notification. If you have placed an order affected by a price change we will contact you and will not proceed with the order without your consent. We reserve the right to alter or remove any special offers from time to time and as necessary.

Cancelled or Amended Orders

As we manufacture to order with the majority of our products any cancellations must be phoned through within 30 minutes of the order being placed. We reserve the right to charge cancellation fees if a cancellation is received after this time.

Liability

Choccotastic Ltd shall not be liable for any failure to deliver the products arising from circumstances outside of their control. We do not take any responsibility for the goods once delivered.

Use of Communications Facilities

When using the enquiry form, or any other System on the Website you should do so in accordance with the following rules: You must not use obscene or vulgar language; You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or  racist; You must not submit Content that is intended to promote or incite violence; It is advised that submissions are made using the English language as we may be unable to moderate any other languages; The means by which you identify yourself must not violate these Terms and Conditions or any applicable laws; You must not impersonate other people, particularly employees and representatives of Choccotastic Ltd; and You must not use our System for unauthorised mass-communication such as “spam” or “junk mail”. You acknowledge that Choccotastic Ltd reserves the right to monitor any and all communications made to us or by using our System. You acknowledge that Choccotastic Ltd may retain copies of any and all communications made to us or using our System.

Changes to Policy

We take great care to ensure our privacy policy is updated as and when necessary. We will continue to review this frequently to obtain the best service we can provide to our customers. Please check our terms and conditions regularly.

Intellectual Property

All Content included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Choccotastic Ltd. By continuing to use the Website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws. Subject to Fair Use of Intellectual Property below, you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given express written permission to do so by Choccotastic Ltd.

Fair Use of Intellectual Property

Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

This Website may contain links to other sites. Unless expressly stated, these sites are not under the control of Choccotastic Ltd. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them.

Parties & Workshops

Your party/workshop will last for the time shown on the information page on our website. 

Starting time : please do not arrive more than 10/15 minutes prior to the start of your party.

Finishing time : please be prompt in leaving as we may well have another party joining us.

Guests are not permitted to bring any external food or drink to be consumed on the premises.

Allergies and/or intolerance : In accordance with our insurance policy requirements, any known food allergies or intolerances must be brought to the attention of Choccotastic staff before the party/workshop starts. Please note: we use products that contain milk, wheat, soya and traces of nuts. We cannot cater to specific allergen or dietary requirements for our parties/workshops unless specified in the information section.

Whilst every care will be taken to ensure that safety procedures are strictly adhered to and risk assessments have been undertaken, Choccotastic Ltd cannot be held responsible for injuries arising as a result of the guest not complying with the safety rules and our instructions.

Photographs/ videos taken by Choccotastic staff during the course of a party/workshop could be used for marketing purposes. Photographs/ videos will not be distributed to a third party. Please let a member of Choccotastic staff know before the party starts if any children are NOT to be photographed/filmed due to safeguarding reasons. Names are not included in our use of the photographs/videos.

Date Change : If you need to change the date of the party/workshop, a minimum of 4 weeks notice is required.

Delays by you:

If you are going to be delayed (for example due to traffic), you must notify us of this as soon as possible.

If you are slightly delayed, we will do our best to accommodate you, but you understand and accept that, in order to avoid overrunning into another group session, your overall session time may be reduced accordingly.

If you are delayed or late (for whatever reason), we will do our best to accommodate you. However, if we cannot accommodate you, you understand and accept that we are entitled to end the contract with you and you will not be entitled to a refund.

Changing or cancelling your booking

Once a booking is accepted, full payment made and your session is confirmed then any cancellation must be made no less than 6 weeks prior to the commencement of your session. Any cancellation after that time will not be entitled to a refund. As set out above and at our discretion we may offer an alternative date and time for you, but you understand and accept that this is dependent on availability and that we will not provide a refund.

Subject to above, if you wish to make a change to the time or date of your booking, please contact us. We will let you know if the change is possible. If it is possible, we will let you know about any changes to the price of the Services, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

If your party/ workshop is cancelled by ourselves, an alternative date or dates will be offered. If no alternative date can be agreed upon, a full refund paid in respect of such cancelled party/ workshop will be given, but shall have no further liability whatsoever.

Our right to exclude you from the party/ workshop/ premises:

You understand and accept that the health and safety is very important to us.

We may require you (or any member of your group) to leave the party/workshop/ our premises immediately if, in our opinion (and acting reasonably), you (or any member of your group) are:

a) failing or refusing to follow our reasonable safety instructions;

b) are in our opinion not in well health (i.e. showing signs of cold or flu);

c) acting in a way that poses a risk to the safety and/or welfare of any other person; or

d) under the influence of (or otherwise impaired by) drugs or alcohol.

If we ask you (or any member of your group) to leave the party/workshop/premises in accordance with clause above, we are entitled to cancel the contract with you (and/or the applicable member of your group) and you will not be entitled to a refund.

Choccotastic Ltd will retain your details on a confidential database for administration and marketing purposes. Your information will not be passed on to any other third party without your prior written consent. If you’d prefer we not contact you again, please advise and we will ensure your name is removed from our mailing list.

Attendance at a Choccotastic party/workshop implies your acceptance of these terms and conditions.
